My girlfriend is having a hard time getting a job, so I told her to do what she knows how to do. We’re planing on starting like a little bakery at her house. We’re planing on making simple cakes and cupcakes and cookies for sale. You know for like little birthday bash or something. We’re not gonna make them just to put them on displace and people come in to buy like its a store, instead we’re going to sell them upon a customers order or request for a cake cupcake or whichever. I would like to know can I get in trouble with the government for that? (I live in Pennsylvania by the way). Will the government come after me if I sell people cakes because of some safety hazard or whatever the government might make up to get to me. She can’t get a job so why not sell cakes when customers order, right? Im planing on creating fliers and putting them all over town and passing out business cards and such so people can know about it. Technically speaking its not a business but a hobby because she’s not gonna do it full-time it’s only when people order it. So anyone with an answer let me know will we get introuble with the government for such a thing?

Yes. You cannot sell food to the public without a license and a health inspection certificate.
You cannot even operate a hot dog cart without proper inspections, licenses, and a business tax number.
The government is required to periodically inspect all food related businesses to ensure that you are operating under state guidelines.
You cannot sell any food product unless you are preparing it in a commercial kitchen. The state will not issue you a license until they have confirmed this.
You cannot pass out business cards unless you are a licensed business and have a business tax number. The government wants their cut.
Any small businesses that you see that are doing all this without proper credentials are doing it illegally and are in danger of fines and perhaps even jail time, if a customer became ill or died from consuming their product.
It’s an expensive project, but if done the right way, can be very rewarding and maybe the start of a good business.
